Write FDA meeting follow-up and clarification correspondence

How should you prepare FDA meeting clarification correspondence?

Identify the official minutes or WRO, its receipt date and the exact advice needing clarification. State the ambiguity and your proposed interpretation without changing the underlying proposal. Under the August 2026 guidance, submit an in-scope Request for Clarification within 20 calendar days after receipt; disagreements about the record and new scientific issues have distinct handling.

What you will prepare: A specific, evidence-linked follow-up that does not invent agency agreement.

Identify the controlling communication

Keep the meeting request, package, preliminary responses, meeting notes, official FDA minutes or written response only, and later addenda as separate dated records. Preliminary responses are not automatically final. FDA’s minutes are the official meeting record; for WRO, the written response serves that role. INTERACT has the guidance’s specific annotated-preliminary-response process.

Make an internal action table: FDA statement, source/date, sponsor interpretation, agreed action, owner, due date and unresolved question. Do not promote the sponsor’s own minutes into an agency agreement or merge qualifications out of a sentence.

Separate clarification from disagreement and new advice

The final guidance §XI permits a formal “Request for Clarification” within 20 calendar days after receipt of minutes or WRO for questions clarifying the advice actually given. It describes an FDA written response within 20 calendar days for questions meeting that scope. New proposals or issues are not converted into clarifications by changing their title.

For a significant difference in understanding of the minutes, contact the project manager; if unresolved, submit the specific disagreement through the process described in §XI. FDA may document necessary changes in an addendum, or the minutes may stand. Preserve the outcome instead of silently editing the agency text in an internal copy.

Write a follow-up that can be answered precisely

Editorial outline: application, meeting date/type, communication being addressed and its receipt date; exact question or section; concise paraphrase of the FDA advice; the ambiguity; proposed interpretation; specific confirmation requested; supporting context already discussed. Where quoting official correspondence, preserve its conditions and meaning.

Fictional exercise: minutes say a proposed analysis may be acceptable if prespecified; the team asks whether a retrospective analysis is now acceptable. That changes the proposal rather than merely clarifying the advice. Route the new issue through an appropriate request instead of asserting FDA already agreed. If the official minutes have not arrived, label the current understanding provisional.

Keep the agency text intact and put the sponsor’s interpretation in a separate field. The most useful follow-up record links the advice to a specific question and its qualifications, rather than recording only a green “FDA agreed” status.

Qualification exercise: FDA advice accepts an analysis approach subject to prespecification and a stated sensitivity analysis. Record both conditions beside the action item. If the team asks whether the sensitivity analysis can be omitted because new results are favorable, that changes the proposal. It should not be described as confirmation of an existing unconditional agreement.

Create separate dates for receipt of minutes/WRO, submission of clarification and FDA’s response. Section XI’s 20-calendar-day response timeframe applies to questions meeting the clarification criteria. An out-of-scope issue may need a new meeting; a division may also answer a narrow issue as general correspondence at its discretion. Do not promise the clarification timetable for that different route.

When minutes are disputed, retain the official version, the submitted disagreement and any FDA addendum. If FDA leaves the minutes unchanged, preserve that disposition and the remaining disagreement rather than editing the agency record. For WRO, the written response itself serves as the meeting record. For INTERACT, use the guidance’s specific annotated-preliminary-response treatment where advice changes.

Trace the record back to the background package. When the follow-up becomes a new decision, prepare an appropriately scoped meeting request instead of disguising it as a correction.

Frequently asked questions

When does the 20-day clarification period begin?

The final guidance describes submission within 20 calendar days after receipt of FDA’s meeting minutes or WRO. Record that actual receipt date, not the meeting date or the date someone later updates an internal tracker. The correspondence must concern clarification of advice already provided to fit this process.

Can clarification correspondence ask FDA to approve a new proposal?

That is outside the stated clarification scope. Identify whether the request changes a design, population, analysis or other proposal rather than resolving an ambiguity in prior advice. FDA may direct a new interaction, or answer a narrow issue as general correspondence at its discretion; the clarification timetable should not be assumed.

Are the sponsor’s meeting notes an official FDA agreement?

No. Preserve them as the sponsor’s record while distinguishing FDA’s official minutes or WRO. Preliminary responses and later addenda also have their own status. If there is a significant difference in understanding, use the guidance’s project-manager and disagreement process rather than relabeling internal notes as agency agreement.

Does an unanswered clarification request mean FDA agreed with the sponsor’s interpretation?

No. The response timeframe does not turn silence into concurrence. Keep the question open and follow up through the appropriate contact. Record the actual FDA disposition and any conditions before treating an interpretation as agreed or changing the development plan on that basis.
