What should an IND withdrawal letter and closeout record contain?
Identify the effective IND, sponsor, product and unequivocal withdrawal decision, with the actual reason and relevant dates. Coordinate notification to FDA and current investigators, ending investigations and accounting for drug stocks. If safety is a reason, promptly notify FDA, participating investigators and reviewing IRBs with the reasons. Track those actions alongside the notice.
Before you begin
Sponsor withdrawal of an effective IND under 21 CFR 312.38. It is different from inactivation, clinical hold and FDA termination.
What you will prepare: A factual withdrawal notice and accountable clinical/drug closeout worklist.
Confirm withdrawal is the intended status change
Section 312.38 permits a sponsor to withdraw an effective IND without prejudice. Confirm the IND number, sponsor, product, studies involved and the authorized decision to end the IND. If the team is planning a temporary pause with possible resumption, assess inactive status separately rather than treating the two labels as interchangeable.
Determine whether safety is a reason. Under §312.38(c), a safety withdrawal requires prompt notification to FDA, participating investigators and reviewing IRBs, with the reasons. A business-oriented cover letter cannot conceal a material safety rationale.
Write the notice alongside the actual closeout plan
Editorial outline: sponsor/application identity; unequivocal notice of withdrawal; actual reason and relevant date; scope of investigations; status of investigator notifications; clinical closeout and unused-drug disposition; references to relevant safety communications; responsible contact. Distinguish completed actions from planned actions and supply accurate dates.
The regulation requires notification to FDA, ending all clinical investigations under the IND, notification of all current investigators, and return or other disposition of drug stocks under §312.59. Have clinical and safety owners establish a participant-protection plan; an administrative author should not invent clinical instructions. Retain drug-accountability and closeout evidence through the applicable record controls.
Worked check: active investigators remain unaware
Fictional exercise: the withdrawal letter is ready, but an investigator remains active and the drug-disposition plan is unanswered. Those operational obligations are not completed by saving the letter. Name owners, communicate through the established channels and track actual completion.
Change the reason from portfolio reprioritization to an emerging safety risk. The notice and coordination now must accurately reflect the safety reason and the additional IRB notification boundary. If the reason is uncertain, obtain the sponsor’s factual determination rather than marking “administrative” by default.
Track notification and drug disposition by investigator
A single “sites notified” checkbox can hide an uncontacted investigator or unresolved stock. Build an internal worklist from the current investigator and drug-accountability records. Use named owners and actual evidence instead of copying a planned completion date into every row.

Section 312.59 permits sponsor-authorized alternative disposition if it does not expose humans to risks from the drug, and requires written disposition records. “Destroy all stock” is therefore not a universal instruction to paste into the letter. The responsible sponsor personnel must determine and document the actual arrangement.
Handoff exercise: a site confirms receipt of the withdrawal email but its unused-drug count differs from the sponsor’s inventory. Mark notification complete and stock reconciliation open. The email is evidence of communication; it does not establish the disposition of missing units. Escalate through the sponsor’s established drug-accountability process, preserving the discrepancy and its resolution.
Keep the letter concise by referencing controlled records where appropriate. Describe an unfinished action as planned or outstanding; do not certify that all investigations and stocks are closed simply because the notice is ready to send. Compare the decision with inactive IND status before using a withdrawal template, and use the status-change map if the starting state is unclear.

Frequently asked questions
Must an IND withdrawal explain whether safety is a reason?
The factual reason must be accurate. When withdrawal is for a safety reason, §312.38(c) requires prompt notification to FDA, participating investigators and reviewing IRBs together with the reasons. Calling the action administrative does not remove that requirement when the underlying facts include a safety rationale.
Does submitting the withdrawal letter complete clinical closeout?
No. Section 312.38 separately addresses ending investigations, notifying current investigators and returning or otherwise disposing of drug stocks. The letter can describe and coordinate that work, but submission alone is not evidence that the operational actions occurred. Retain the actual closeout and disposition records.
Must all unused investigational drug be destroyed?
Not necessarily. Section 312.59 requires the sponsor to assure return of unused supplies and permits an authorized alternative disposition that does not expose humans to risks from the drug. Document the chosen arrangement and its completion; do not substitute a generic destruction statement for the actual stock record.
Can a withdrawn IND restart using the inactive-IND 30-day rule?
Do not apply that rule merely because the sponsor wants to restart. Section 312.45(d) concerns an IND placed on inactive status. Withdrawal is a different starting state. Establish the appropriate submission and agency process for the actual record before planning any resumption of clinical investigation.
