Prepare a tropical-disease priority review voucher request

How do you prepare a tropical-disease priority review voucher request?

First distinguish a request to earn a voucher from transfer or use of an existing voucher. For an award request, map the application to current disease, pathway, priority-review, ingredient and clinical-evidence criteria, including the later statutory additions described by FDA. Support each attestation with records; the 2016 guidance alone is not a complete current eligibility checklist.

Before you begin

Tropical-disease vouchers under FD&C Act section 524. Rare-pediatric vouchers and the Commissioner’s voucher pilot are different programs.

What you will prepare: A current eligibility evidence record or redemption worklist with the correct program identified.

For an award request, test every current eligibility element

Identify the tropical disease and verify that it is included under the current statutory/program list or an applicable designation order. A candidate disease mentioned in a docket is not necessarily designated. Document the qualifying application pathway, priority-review eligibility and prior-approval history of the active ingredient, including the relevant salt/ester analysis.

FDA’s current program page explains additional requirements for applications submitted after September 30, 2017: qualifying new clinical investigations other than bioavailability studies, essential to approval and conducted or sponsored by the sponsor, plus the specified attestation about prior submission of those reports to the identified foreign authorities before September 27, 2007. The final 2016 guidance predates these additions; do not stop at its older checklist.

Prepare the evidence before any attestation

Draft an eligibility table with each program criterion, the underlying record, the proposed conclusion and a regulatory/legal owner. Include clinical report identities, sponsorship documentation and a reproducible historical-submission inquiry for the attestation. Explain uncertainty instead of inserting “never submitted” when legacy records are unavailable.

The request should identify the application and product, state the voucher program and purpose, present the evidence supporting each criterion, and point to the supporting reports. A tropical-disease indication alone is insufficient to establish eligibility. Preserve the actual FDA award correspondence if a voucher is awarded.

For an existing voucher, control ownership and use separately

Redemption concerns a subsequent application. Confirm the voucher identity, current holder, documented transfer chain where applicable, intended application, applicable notice requirements and current fiscal-year fee. The voucher-use fee is distinct from other application fees. Obtain current program instructions before committing a filing date; this guide deliberately does not freeze a fee amount.

Fictional exercise: an applicant possesses a purchase agreement but not evidence that the transfer/ownership record is complete. Do not describe the voucher as ready for redemption until the responsible owner resolves that gap. If the instrument is a rare-pediatric voucher or another program’s voucher, reassess under that program rather than reusing the tropical-disease award criteria.

Prepare an award-request record before drafting the conclusion. This is a working aid for the regulatory and legal reviewers, not a ready-to-sign attestation.

For the historical-submission inquiry, identify the specific reports supporting the request. Record the repositories searched, legacy organizations involved, jurisdictions considered, records located and remaining gaps. Have the responsible reviewer connect the inquiry to the exact attestation described by the current program. “Nothing found in our current drive” is a search result with a limited scope, not proof about every historical submission.

Transaction exercise: the team receives an existing voucher through two successive transfers and starts filling out an award-eligibility table. Redirect the work to voucher identity, the documented transfer chain and the intended subsequent application. The 2016 guidance’s transfer discussion calls for a complete transfer record for redemption. Separately verify current notice and fee instructions for the planned use; a purchase agreement alone does not complete those tasks.

Do not populate this guide with a fee that silently becomes stale at the next fiscal year. Record the applicable fee source, fiscal year and date checked in the actual redemption worklist. Keep the voucher fee distinct from the application’s other fee obligations.

No. FDA’s current program page describes additional requirements for applications submitted after September 30, 2017, including qualifying investigations and the specified historical-submission attestation. Read the older final guidance with those additions rather than assuming its publication status makes every eligibility discussion complete today.

Does a disease proposed in FDA’s public docket already qualify for the program?

Not merely because it was proposed. FDA distinguishes candidate submissions from diseases designated through the applicable process. Verify the current qualifying list or relevant final order and its actual scope. A docket title or discussion of a possible disease is insufficient evidence of designation.

Must an application redeeming a tropical-disease voucher itself treat a tropical disease?

The program distinguishes the qualifying application that earns the voucher from the subsequent application using it. FDA explains that an awarded voucher can obtain priority review designation for a later application that would not otherwise qualify. Verify the intended use and current program conditions without copying award criteria into redemption.

Is a voucher purchase agreement enough to establish readiness for redemption?

No. Reconcile the actual voucher and documented transfer chain, then address the intended application’s notice and fee work. FDA’s guidance calls for a complete transfer record to be available for redemption. Commercial ownership documentation does not itself demonstrate that every regulatory step is complete.
