How do you withdraw a pending FDA marketing application or supplement?
Verify that the specific submission is still unapproved, then prepare an authorized written notice identifying exactly what is being withdrawn. Section 314.65 governs unapproved NDA withdrawal and §314.99 applies it to ANDAs. For a BLA, confirm the center’s process. Preserve the acknowledgement, identified deficiencies and separately assessed continuing obligations.

Confirm the application is still unapproved
Check the latest FDA action and identify the base application, supplement and products affected. Under §314.65, an applicant may withdraw an unapproved NDA by written notification; §314.99 applies that provision to an ANDA. Withdrawal is without prejudice to refiling, and FDA’s acknowledgement can identify deficiencies already found. It is not an approval of the withdrawn data or a promise that refiling will succeed.
For a BLA or BLA supplement, confirm the receiving center’s administrative process with the project manager. Do not cite §314.65 as if it directly governs all BLAs. If approval has already occurred, the withdrawal-of-approval or license-revocation process is a different task.
Write a notice with an unmistakable boundary
Editorial outline: applicant; product; application and exact supplement number; pending submission being withdrawn; clear statement of the requested action; factual reason; date; related pending submissions that are or are not included; responsible contact; authorized execution. Have the regulatory owner verify that the wording matches the business decision.
Create an internal consequence record for user-fee questions, related trials, safety reporting, referenced commitments and future data use. This letter does not itself determine refunds, erase safety responsibilities or withdraw another application. Preserve the actual FDA acknowledgement and use it in any future resubmission history.
Worked check: withdraw a supplement, preserve the base approval
Fictional exercise: an applicant abandons a proposed additional indication but continues marketing the approved indication. A notice saying “withdraw NDA [number]” is dangerously broad. Identify the pending efficacy supplement explicitly and have the authorized owner confirm the scope.
If the supplement was approved before the notice is finalized, stop and reassess the route. If the action date is missing, the document remains a draft until the current status is verified.
Reconcile identifiers immediately before sending the notice
Create an internal scope record that matches the final notice. Its value is precision: a reader should not need the project’s history to determine whether the applicant means the whole pending application or one supplement.

Writing exercise: replace “We withdraw our application for Product X” with a statement identifying the actual pending application or supplement number and its purpose. For a pending supplemental indication under an approved NDA, explicitly reconcile the requested action with the continuing base approval. The example is an editorial pattern; the final wording must follow the actual authorized scope and receiving center’s procedure.
After submission, retain the final version and acknowledgement together. Section 314.65 provides for FDA to identify deficiencies already found by the time it receives the notice and to retain the application. Build any later filing plan from that history and the then-applicable requirements. Do not describe withdrawal as deletion of the regulatory record.
Keep fee questions, study decisions and safety obligations on separate assigned work items rather than making unsupported promises in the notice. Frequently asked questions
Does withdrawal without prejudice guarantee that a later filing will be approved?
No. It preserves the ability to refile; it does not validate the withdrawn application or resolve its deficiencies. Retain FDA’s acknowledgement and any deficiencies identified there, then assess the evidence and requirements relevant to the later filing. Do not describe withdrawal as a favorable review conclusion.
Does FDA delete an unapproved application after the applicant withdraws it?
No. Section 314.65 states that FDA retains the application and provides a copy on request under its public-information fee schedule. Preserve the sponsor’s own controlled record as well; withdrawal should not be treated as erasing the submission history or making earlier statements disappear.
Does the NDA withdrawal provision automatically apply to every BLA?
No. Section 314.99 expressly applies §314.65 to unapproved ANDAs, but that is not a general rule for BLAs. Confirm the relevant biologics center’s administrative process and the specific pending submission with the project manager. Do not cite the NDA provision as the authority for every biologic withdrawal.
What if FDA approves the submission before the withdrawal notice is sent?
Reassess the route using the actual approval and the intended scope. The unapproved-application procedure no longer describes an approved submission. Distinguish withdrawal of approval, a change to an approved product or use, and marketing discontinuation before finalizing the action; do not send the earlier draft unchanged.
