Part 10 — Where standard prescribed for drug
This section mandates that any substance labeled, packaged, sold, or advertised in a way that it could be mistaken for a drug must comply with the applicable standard for that drug. This includes prescribed standards, standards found in Schedule B publications, or, if neither exists, the drug's professed standard. It also prohibits the sale of non-standardized drugs if they deceptively resemble standardized ones.
What this part covers
- Any substance labeled, packaged, sold, or advertised in a manner likely to be mistaken for a drug with a prescribed standard must comply with that prescribed standard.
- Any substance labeled, packaged, sold, or advertised in a manner likely to be mistaken for a drug with a standard contained in a Schedule B publication must comply with that standard.
- A drug for which no standard is prescribed or contained in a Schedule B publication must be sold in accordance with its professed standard.
- A drug for which no standard is prescribed or contained in a Schedule B publication must not resemble, in a manner likely to deceive, any drug for which a standard has been prescribed or is contained in a Schedule B publication.
