Part 16.1 — Prohibited sales — animal testing
This section prohibits the sale of cosmetics if their safety is established using data derived from animal testing that caused pain, suffering, or injury. It outlines several exceptions where this prohibition does not apply, primarily covering publicly available data, data published by the Government of Canada, data from tests conducted for non-cosmetic regulatory requirements, and data or products existing before the section's effective date.
What this part covers
- No person shall sell a cosmetic unless its safety can be established without relying on data from animal tests that caused pain, suffering, or injury to the animal.
- The prohibition does not apply if the Government of Canada has published the data in a scientific journal or on a Government of Canada website.
- The prohibition does not apply if the data is publicly available and was not sponsored or conducted by or on behalf of a person who manufactures, imports, or sells the cosmetic.
- The prohibition does not apply if the data is from a test conducted on a substance to meet a requirement under an Act of Parliament or its regulations (excluding cosmetic-only requirements), or a non-cosmetic requirement in a foreign state, provided the substance was used in a non-cosmetic product legally sold in that country, and the test was necessary to meet that requirement.
- The prohibition does not apply if the data is derived from a test conducted before the day this section comes into force.
- The prohibition does not apply if the cosmetic was sold in Canada at any time before the day this section comes into force.
- The prohibition does not apply if any prescribed circumstance applies.
