Part 16.1 — Prohibited sales — animal testing

  • No person shall sell a cosmetic unless its safety can be established without relying on data from animal tests that caused pain, suffering, or injury to the animal.
  • The prohibition does not apply if the Government of Canada has published the data in a scientific journal or on a Government of Canada website.
  • The prohibition does not apply if the data is publicly available and was not sponsored or conducted by or on behalf of a person who manufactures, imports, or sells the cosmetic.
  • The prohibition does not apply if the data is from a test conducted on a substance to meet a requirement under an Act of Parliament or its regulations (excluding cosmetic-only requirements), or a non-cosmetic requirement in a foreign state, provided the substance was used in a non-cosmetic product legally sold in that country, and the test was necessary to meet that requirement.
  • The prohibition does not apply if the data is derived from a test conducted before the day this section comes into force.
  • The prohibition does not apply if the cosmetic was sold in Canada at any time before the day this section comes into force.
  • The prohibition does not apply if any prescribed circumstance applies.
