Part 21.5 — Injunction

  • A court of competent jurisdiction may issue an injunction upon the Minister's application if a person has committed, is about to commit, or is likely to commit an offense under this Act concerning a therapeutic product.
  • The injunction may order the named person to refrain from actions that constitute or are directed toward the commission of the offense.
  • The injunction may order the named person to do anything that may prevent the commission of the offense.
  • An injunction must not be issued unless 48 hours' notice is served on the party or parties named in the application.
  • The 48-hour notice requirement may be waived if the urgency of the situation is such that service of notice would not be in the public interest.
