Part 6 — Importation and interprovincial movement of food
This regulation prohibits the importation, interprovincial movement, possession for such movement, labeling, packaging, selling, or advertising of any article intended for sale that is likely to be mistaken for a food for which a standard has been prescribed, unless that article complies with the prescribed standard. An exemption is provided for conveyance operators and carriers, unless they could have reasonably ascertained that the article's conveyance or possession would be in contravention.
What this part covers
- No person shall import into Canada any article intended for sale that is likely to be mistaken for a food with a prescribed standard, unless the article complies with that standard.
- No person shall send, convey, or receive for conveyance from one province to another any article intended for sale that is likely to be mistaken for a food with a prescribed standard, unless the article complies with that standard.
- No person shall have in possession for the purpose of sending or conveying from one province to another any article intended for sale that is likely to be mistaken for a food with a prescribed standard, unless the article complies with that standard.
- No person shall label, package, sell, or advertise any article (imported or interprovincially moved/intended for movement) in a manner that it is likely to be mistaken for a standardized food, unless the article complies with the prescribed standard.
- Operators of conveyances and carriers are exempt from prohibitions related to conveying or possessing articles for conveyance, unless they could have reasonably ascertained that the article contravened the prescribed standard.
